How Illinois Calculates Child Support

Illinois calculates child support under the Income Shares model, codified at 750 ILCS 5/505. This approach combines both parents’ net incomes and the number of children to arrive at a basic support obligation, reflecting the financial benefit the child would receive if both parents shared a household. The model replaced Illinois’s older percentage-of-payor-income approach in 2017, and the state periodically revises the underlying income tables to keep pace with current economic conditions.

Two factors frequently complicate the calculation:

Shared parenting time: When each parent has at least 146 overnights per year with the child, Illinois applies a different shared parenting formula rather than the standard one. That threshold is scheduled to drop to 110 overnights starting January 1, 2027, under a recently signed update to the Illinois Marriage and Dissolution of Marriage Act, so parents near that line should pay attention to the change.
Add-on costs: Health insurance premiums and work-related childcare expenses are divided between the parents as additional obligations on top of the base amount.

Illinois updates its gross-to-net income conversion table each year, and since 2024 also updates the basic support obligation schedule annually. An existing support order doesn’t adjust itself when your circumstances change. Illinois courts require a showing of a substantial change in circumstances before they’ll revisit an existing order, and what qualifies depends on the facts of your case.

One detail that catches parents off guard: a modification changes the support amount going forward from the date the other parent is notified that the petition has been filed. Amounts already owed before that date generally can’t be reduced retroactively. Waiting months before filing, or before making sure the other parent has been properly notified, can leave you responsible for arrears at the old amount even if a judge ultimately agrees the order should change.

Enforcing Unpaid Child Support in Illinois

When a parent falls behind on payments, Illinois provides several enforcement tools. The Illinois Department of Healthcare and Family Services’ Division of Child Support Services administers enforcement, including automatic income withholding orders that pull support directly from a payor’s wages. Courts can also order driver’s and professional license suspension, state and federal tax refund interception, credit bureau reporting, and contempt proceedings for persistent nonpayment.

A significant change took effect in 2021: Illinois stopped automatically charging 9% annual interest on past-due child support. Interest is now assessed only when a court orders it, and prior unadjudicated interest balances were zeroed out under that policy change. It’s also worth noting that withholding parenting time isn’t a lawful response to unpaid support, and falling behind on payments doesn’t strip a parent of parenting time rights. Under Illinois law, support and parenting time are treated as separate legal obligations.

Illinois child support generally continues until a child turns 18. If the child is still enrolled in high school at that point, the obligation can extend through graduation, up to age 19.
